How do Architects / Engineers and Quantity Surveyors Protect House Buyers' Monies through the Project Account Rules 1995?

  

Apart from their design work, professional Architects / Engineers and Quantity Surveyors play important roles in compliance of the Project Account Rules which ensure that hard-earned consumers / house-buyers' money are properly employed for the purpose of the project and not mis-directed somewhere else.

 

Licensed housing developers have to deposit into the Project Account all monies received for theproject, which includes monies paid purchasers in relation to their purchases of the housing accommodation in the development. Monies obtained by housing developers through loan for their housing projects shall also be deposited into the Project Account.

 

The Project Account Rules list out specific instances where payments can be made and this include :

* payments for quit rents, rates, taxes, assessments, stamp duty, etc

* legal fees for sale and purchase agreement

* insurance premiums

* fees for architects, engineers, quantity surveyors and other consultants

* payments for soil investigations, building works, external works, infrastructure works, survey, etc related to the housing development

* payments for contribution to local authorities for power / water / telephone / etc authorities

* payments for administrative expenses including marketing and advertising incurred on the housing development, subject to a maximum of 20% of the total cost of construction of the housing development

* etc as detailed in the Project Account Rules

 

What Roles do Architects / Engineers and Quantity Surveyors play in the implementation of the Project Account Rules ?


No monies from the Project Account of a housing development shall be withdrawn except where the withdrawal is certified by an Architect or Engineer with a supporting valuation by a Quantity Surveyor. The certification should state that payment is due to be made for a specified purpose in accordance to the Project Account Rules.


Payment Certificates must either be signed by an Architect or Engineer. Regardless of whether it is signed by Architect or Engineer, payment certificates have to be "supported by an evaluation by the quantity surveyor". Therefore, there are at least two signatures to look for - ie the Architect or Engineer's signature plus the supporting QS' signature.


Who are the qualified Architects or Engineers or Quantity Surveyors who can sign these payments ?  These professionals should be qualified professionals who are registered with their respective professional Boards.  The list of professional architects / engineers / quantity surveyors and registered respective consulting practices can be found in their respective boards' websites :

So, in theory, as long as Architects / Engineers and Quantity Surveyors do proper valuation and certification, housing developers will not be able to get any improper payments or misuse house buyers / consumers monies or be overpaid.  Hence, house buyers / consumers interests are protected.

Bagaimanakah Arkitek / Jurutera dan Juruukur Bahan Melindungi Wang Pembeli Rumah 'melalui Peraturan Akaun Projek 1995?

 


Selain daripada kerja-kerja reka bentuk mereka, Arkitek / Jurutera dan Juruukur Bahan adalah profesional yang memainkan peranan penting dalam pematuhan Peraturan Akaun Projek memastikan wang hasil titik peluh pengguna / pembeli rumah digunakan dengan betul untuk tujuan projek dan tidak disalaharahkan tempat lain.

 


Pemaju perumahan berlesen perlu mendepositkan ke dalam Akaun Projek semua wang yang diterima untuk projek, termasuk wang yang dibayar pembeli berhubung pembelian rumah mereka dalam pembangunan projek itu. Wang yang diperolehi oleh pemaju perumahan melalui pinjaman untuk projek-projek perumahan mereka juga hendaklah dimasukkan ke dalam Akaun Projek.

 


Peraturan Akaun Projek menyenaraikan keadaan-keadaan tertentu di mana bayaran boleh dibuat dan ini termasuk:

* Bayaran untuk sewa tanah, kadar, cukai, taksiran, duti setem, dll

* Yuran guaman untuk perjanjian jual-beli

* Premium insurans

* Yuran ikhtisas perunding arkitek, jurutera, juruukur bahan dan perunding-perunding lain

* Bayaran penyiasatan tanah, kerja-kerja binaan, kerja-kerja luaran, kerja-kerja infrastruktur, kaji selidik, dan lain-lain yang berkaitan dengan pembangunan perumahan

* Bayaran Sumbangan kepada pihak berkuasa tempatan untuk kuasa / air / telefon / dll

* Bayaran perbelanjaan pentadbiran termasuk pemasaran dan pengiklanan yang dilakukan ke atas pembangunan perumahan, tertakluk kepada maksimum 20% daripada jumlah kos pembinaan pembangunan perumahan

* dll seperti yang disenaraikan dalam Peraturan Akaun Projek

 

 


Apakah Peranan Arkitek / Jurutera dan Juruukur Bahan bermain dalam pelaksanaan Peraturan Akaun Projek?

 


Tiada wang daripada Akaun Projek pembangunan perumahan boleh dikeluarkan atau dibayar kecuali di mana pembayaran itu disahkan oleh Arkitek atau Jurutera dengan penilaian yang disokong oleh seorang Juruukur Bahan. Perakuan Bayaran ini hendaklah menyatakan bahawa pembayaran itu kena dibuat bagi suatu maksud tertentu mengikut Peraturan Akaun Projek.

 


Sijil Bayaran mestilah ditandatangani oleh Arkitek atau Jurutera. Tanpa mengira sama ada ia ditandatangani oleh Arkitek atau Jurutera, sijil pembayaran perlu "disokong oleh penilaian oleh juruukur bahan". Oleh itu, terdapat sekurang-kurangnya dua tandatangan yang diperlukan untuk pembayaran - iaitu tandatangan Arkitek atau Jurutera dan juga sokongan tandatangan Jurukur Bahan.

 


Siapakah Arkitek atau Jurutera atau Juruukur Bahan yang berkelayakan menandatangani bayaran ini? Mereka ini adalah profesional yang berkelayakan yang berdaftar dengan Lembaga profesional masing-masing. Senarai arkitek / jurutera / juruukur bahan profesional dan syarikat perunding berdaftar boleh didapati di laman web lembaga masing-masing seperti berikut :

Jadi, dalam teori, selagi Arkitek / Jurutera dan Juruukur Bahan melakukan penilaian dan pensijilan dengan betul, pemaju perumahan tidak akan dapat apa-apa bayaran yang tidak wajar atau menyalahgunakan wang pembeli rumah / pengguna atau dibayar berlebihan. Oleh itu, kepentingan pembeli rumah / pengguna dilindungi.
