What are the Responsibilities of Bankers in Protecting The Interests of House Buyers / Consumers ?

 

 


Housing developers have to open a Project Account with a bank when issued with a housing development license.

 


No monies from the Project Account of a housing development shall be withdrawn except where the withdrawal is certified by an Architect or Engineer with a supporting valuation by a Quantity Surveyor. The certification should state that payment is due to be made for a specified purpose in accordance to the Project Account Rules.

 


Therefore, Bankers have to be familiar with the Project Account Rules.

Withdrawals from Housing Project Account need proper supporting documentation before it is allowed. Proper supporting documentation in this case consists of :

* Payment certificate signed by either a registered Architect or registered Engineer

* A supporting valuation (calculation detail for the payment) done by a registered Quantity Surveyor

* The payment certification from the Architect or Engineer should contain a statement stating that payment is due to be made for a specified purpose in accordance to the Project Account Rules.

 

 


Who are the qualified Architects or Engineers or Quantity Surveyors who can sign these payments ? These professionals should be qualified professionals who are registered with their respective professional Boards. The list of professional architects / engineers / quantity surveyors and registered respective consulting practices can be found in their respective boards' websites :

The Project Account Rules is useless if the bank or financial institution make payments or allow developers to make withdrawals from their housing project accounts without compliance to the Rules. In practice, this may actually happen. This is because there are slight differences between Housing Developers Project Account Rules in West Malaysia and in Sabah. Some banks / bank officers involved in the operation of the Project Account may not be familiar at all with Project Account Rules, not to mention the slight differences between our Rules and West Malaysia's Rules.

Apakah Peranan Pegawai Bank dalam Melindungi Kepentingan Pembeli Rumah / Pengguna?

 

 


Pemaju perumahan perlu membuka Akaun Projek dengan bank apabila diberi lesen pembangunan perumahan.

 


Tiada wang daripada Akaun Projek pembangunan perumahan boleh dikeluarkan / dibayar keluar kecuali di mana bayaran itu disahkan oleh Arkitek atau Jurutera berserta sokongan penilaian seorang Juruukur Bahan. Perakuan tersebut hendaklah menyatakan bahawa pembayaran itu kena dibuat bagi suatu maksud tertentu mengikut Peraturan Akaun Projek.

 


Oleh itu, Pegawai Bank perlu tahu Peraturan Akaun Projek.

Pengeluaran dari Akaun Projek Perumahan memerlukan dokumen sokongan sebelum ia dibenarkan. Dokumen sokongan dalam kes ini terdiri daripada:

* Pembayaran perakuan yang ditandatangani oleh Arkitek atau Jurutera berdaftar berdaftar

* Satu penilaian sokongan (pengiraan terperinci bagi pembayaran) yang dilakukan oleh seorang Juruukur Bahan berdaftar

* Sijil bayaran daripada Arkitek atau Jurutera harus mengandungi suatu kenyataan yang menyatakan bahawa bayaran kena dibuat bagi maksud yang dinyatakan selaras dengan Peraturan Akaun Projek.

 

 


Siapakah Arkitek atau Jurutera atau Juruukur Bahan yang berkelayakan menandatangani bayaran ini? Mereka ini adalah profesional yang berkelayakan yang berdaftar dengan Lembaga profesional masing-masing. Senarai arkitek / jurutera / juruukur bahan profesional dan syarikat perunding berdaftar boleh didapati di laman web lembaga masing-masing seperti berikut :

Peraturan Akaun Projek tidaklah berkesan sekiranya bank atau institusi kewangan membuat pembayaran atau membenarkan pemaju mengeluarkan wang dari akaun projek perumahan mereka tanpa pematuhan kepada Peraturan. Perkara ini mungkin boleh berlaku kerana terdapat sedikit perbezaan antara Peraturan Pemaju Perumahan Akaun Projek di Malaysia Barat dan di Sabah. Sesetengah bank / pegawai bank yang terlibat dalam pengedalian Akaun Projek mungkin tidak mengenai semua Peraturan Akaun Projek, apatah lagi berkenaan perbezaan antara Peraturan kami dan Peraturan di Semanjung Malaysia.
